한국자산관리공사 설립 등에 관한 법률 제36조(자료 제공의 요청)

① 공사는 국가, 지방자치단체, 「국민연금법」에 따른 국민연금공단, 「국민건강보험법」에 따른 국민건강보험공단 및 「산업재해보상보험법」에 따른 근로복지공단, 그 밖에 대통령령으로 정하는 공공단체에 제26조제1항제1호가목ㆍ바목, 같은 항 제3호가목ㆍ나목, 같은 항 제4호나목 또는 같은 조 제2항(같은 조 제1항제1호가목ㆍ바목, 같은 항 제3호가목ㆍ나목 또는 같은 항 제4호나목의 업무에 딸린 업무에 한정한다. 이하 이 조에서 같다)에 따른 업무 수행에 필요한 자료의 제공을 요청할 수 있다. <개정 2021.8.17>

② 공사는 다음 각 호의 사항을 적은 문서로 관할 세무관서의 장 또는 지방자치단체의 장에게 과세정보(종합소득세 및 지방세 과세자료에 한정한다. 이하 이 조에서 같다)의 제공을 요청할 수 있다. 이 경우 과세정보 제공 요청은 제26조제1항제1호가목ㆍ바목, 같은 항 제3호가목ㆍ나목, 같은 항 제4호나목 또는 같은 조 제2항에 따른 업무 수행을 위하여 필요한 최소한의 범위에서 하여야 하며, 다른 목적을 위하여 남용하여서는 아니 된다. <개정 2021.8.17>

③ 제1항 및 제2항에 따라 자료의 제공을 요청받은 자는 특별한 사유가 없으면 이에 따라야 한다.

④ 공사는 「채무자 회생 및 파산에 관한 법률」 제49조에 따라 회생절차개시결정을 받은 채무자의 경영정상화 지원을 위하여 필요한 경우에는 채무자의 영업ㆍ사업에 관한 정보 및 자료의 제공을 관리인에게 요청할 수 있다. 이 경우 공사의 요청에 관하여는 「채무자 회생 및 파산에 관한 법률」 제57조를 준용한다. <신설 2021.8.17>

⑤ 공사는 업무 수행을 위하여 제공받은 자료의 목적을 달성한 경우에는 「신용정보의 이용 및 보호에 관한 법률」에 따라 해당 자료를 관리ㆍ삭제하여야 한다. <개정 2021.8.17>

⑥ 제1항, 제2항 또는 제4항에 따른 업무에 종사하고 있거나 종사하였던 사람은 다음 각 호의 어느 하나에 해당하는 경우를 제외하고는 업무를 수행하면서 취득한 정보 및 자료를 다른 사람 또는 기관에 제공하여서는 아니 된다. <신설 2021.8.17>
