학교복합시설 설치 및 운영ㆍ관리에 관한 법률 제5조(학교복합시설의 설치)

① 지방자치단체의 장은 다음 각 호의 어느 하나에 해당하는 경우 학교복합시설을 설치할 수 있다. <개정 2021.3.23, 2025.1.21>

② 제1항에도 불구하고 감독기관장등은 교육활동 및 지역사회의 복리증진을 위하여 학교복합시설 설치가 필요하다고 인정하는 경우 지방자치단체의 장과 협의하여 학교복합시설을 설치할 수 있다. <신설 2021.3.23, 2025.1.21>

③ 제1항 및 제2항에 따라 학교복합시설을 설치하려는 경우 학교복합시설의 기획, 설계 및 공사 등의 건축은 각 항의 설치 주체가 시행하는 것으로 하되, 지방자치단체의 장과 감독기관장등이 협의하여 달리 정할 수 있다. <신설 2021.3.23, 2025.1.21>

④ 학교복합시설의 소유권은 증축ㆍ개축, 리모델링 등 건축방식, 재정 분담 비율 등을 고려하여 지방자치단체의 장과 감독기관장등이 협의하여 정할 수 있으며, 사립학교의 경우에는 학교의 설립주체와 협의하여 정한다. <신설 2021.3.23, 2025.1.21>

⑤ 「초ㆍ중등교육법」 제2조에 따른 학교에 학교복합시설을 설치하는 경우 그 사업시행에 필요한 절차는 이 법에서 정한 경우를 제외하고는 「학교시설사업 촉진법」에 따른다. <신설 2021.3.23, 2025.1.21>

⑥ 그 밖에 학교복합시설의 설치에 관한 구체적인 사항은 대통령령으로 정한다. <신설 2021.3.23>
