폐교재산의 활용촉진을 위한 특별법 제11조(공원계획의 변경 등에 관한 특례)

① 공원관리청은 「자연공원법」에 따른 공원구역에 있는 폐교재산을 대부받아 교육용시설, 사회복지시설 또는 귀농어ㆍ귀촌 지원시설로 활용[건축물의 신축ㆍ증축을 제외한 개축(改築)ㆍ보수 등의 경우만 해당한다]하려는 자가 공원계획의 변경을 신청하는 경우에는 「자연공원법」 제15조에 따른 공원계획의 변경절차에 따르지 아니하고 공원계획을 변경할 수 있다. <개정 2019.8.20>

② 제1항에 따라 공원관리청이 공원계획을 변경한 경우에는 건축물의 개축ㆍ보수 등과 관련하여 「자연공원법」 제20조에 따른 공원사업의 시행허가를 한 것으로 본다.
