특허법 제103조(선사용에 의한 통상실시권)

특허출원 시에 그 특허출원된 발명의 내용을 알지 못하고 그 발명을 하거나 그 발명을 한 사람으로부터 알게 되어 국내에서 그 발명의 실시사업을 하거나 이를 준비하고 있는 자는 그 실시하거나 준비하고 있는 발명 및 사업목적의 범위에서 그 특허출원된 발명의 특허권에 대하여 통상실시권을 가진다.
