특정강력범죄의 처벌에 관한 특례법 제8조(출판물 게재 등으로부터의 피해자 보호)

특정강력범죄 중 제2조제1항제2호부터 제6호까지 및 같은 조 제2항(제1항제1호는 제외한다)에 규정된 범죄로 수사(검사에게 사건이 송치된 경우에는 해당 사건이 송치된 후 공소제기 여부를 결정하기 전까지를 포함한다. 이하 이 조에서 같다) 또는 심리(審理) 중에 있는 사건의 피해자나 특정강력범죄로 수사 또는 심리 중에 있는 사건을 신고하거나 고발한 사람에 대하여는 성명, 나이, 주소, 직업, 용모 등에 의하여 그가 피해자이거나 신고 또는 고발한 사람임을 미루어 알 수 있는 정도의 사실이나 사진을 신문 또는 그 밖의 출판물에 싣거나 방송 또는 유선방송하지 못한다. 다만, 피해자, 신고하거나 고발한 사람 또는 그 법정대리인(피해자, 신고 또는 고발한 사람이 사망한 경우에는 그 배우자, 직계친족 또는 형제자매)이 명시적으로 동의한 경우에는 그러하지 아니하다. <개정 2026.9.29>
