특수임무수행자 보상에 관한 법률 시행령 제13조(공로금 및 특별공로금)

1. 기본공로금은 월 최저임금(이 영 시행일 현재 「최저임금법」 제10조에 따라 고용노동부장관이 고시한 시간단위 최저임금에 226시간을 곱한 금액을 말한다)의 72배에 별표 2에 따른 채용ㆍ입대시기별 지급비율을 곱하여 산정한 금액의 범위안에서 채용ㆍ입대경위, 교육훈련여건, 특수임무종결일 이후의 처리사항 등을 고려하여 위원회가 정하는 금액으로 한다.

2. 가산공로금은 특수임무와 관련한 교육훈련의 과정에서 사망 또는 행방불명으로 처리되거나 신체상의 장해를 입은 특수임무수행자 및 그 유족에게 지급하며, 그 금액은 별표 4 제1호에 따른 특별위로기준금액에 별표 3에 따른 사망ㆍ행방불명ㆍ장해등급별 지급비율을 곱하여 산정한다. 이 경우 장해등급은 「국가배상법 시행령」 제2조를 준용한다.

1. 기본특별공로금은 별표 4 제1호에 따른 특별위로기준금액의 75퍼센트의 범위안에서 제1항제1호에 따른 기본공로금에 특수임무수행시기 및 수행횟수 등을 고려하여 위원회가 정하는 금액을 더하여 산정한 금액으로 한다.
