특별감찰관법 시행령 제10조(출석ㆍ답변의 요구 등)

① 특별감찰관은 법 제17조제1호 또는 제18조제1항에 따라 감찰대상자와 감찰대상자 이외의 자(이하 "감찰대상자등"이라 한다)의 출석ㆍ답변을 요구할 때에는 출석ㆍ답변요구서(「정보통신망 이용촉진 및 정보보호 등에 관한 법률」에 따른 전자문서를 포함한다)를 교부 또는 우편 등의 방법으로 송달한다. 다만, 긴급한 경우에는 감찰대상자등에게 구두로 출석ㆍ답변을 요구할 수 있다.

② 제1항에 따른 출석ㆍ답변요구서에는 출석ㆍ답변할 자의 성명, 출석ㆍ답변할 일시 및 장소, 출석ㆍ답변을 요구하는 취지를 기재한다. 다만, 제1항 단서에 따라 구두로 출석ㆍ답변을 요구한 경우에는 지체 없이 위 기재사항과 함께 구두로 출석ㆍ답변을 요구한 사유를 기재한 서면을 작성하여 보관하여야 한다.

③ 특별감찰관은 제1항에 따라 출석ㆍ답변을 요구하는 방식 대신에 감찰대상자등으로 하여금 서면 또는 전화 등의 방식으로 진술하게 할 수 있다.
