Enforcement Decree of the Act on Response to and Support for Changes in the Trade Environment, etc., Article 10 (Requirements for Designation of Trade Change Response Support Workers, etc.)
①법 제11조제1항에서 "근로자 대표"라 함은 다음 각 호의 어느 하나에 해당하는 자를 말한다. <개정 2010.7.12>
(1) A "worker representative" in Article 11 (1) of the Act means any of the following:
1. 근로자의 과반수로 조직된 노동조합이 있는 경우에는 그 노동조합의 대표자
1. Where there is a labor union organized by a majority of workers, the representative of the labor union;
2. 근로자의 과반수로 조직된 노동조합이 없는 경우에는 해당 기업 근로자의 과반수를 대표하는 자
2. Where there is no labor union organized by a majority of workers, a person representing a majority of the workers of the relevant enterprise;
3. 폐업한 기업의 경우에는 폐업 이전에 제1호 또는 제2호에 해당하는 자
3. In the case of an enterprise that has closed its business, a person falling under subparagraph 1 or 2 before the closure;
4. 폐업한 기업의 경우로서 폐업 이전에 제1호 또는 제2호에 해당하는 자가 없는 경우에는 고용노동부장관이 정하여 고시하는 기준에 적합한 자
4. In the case of an enterprise that has closed its business and there is no person falling under subparagraph 1 or 2 before the closure, a person meeting the criteria determined and notified by the Minister of Employment and Labor.
②법 제11조제2항제1호에서 "실직할 가능성이 높은 경우"라 함은 「근로기준법」 제26조에 따른 해고의 예고를 통지받거나 그 밖에 이에 준하는 방식으로 해고의 예고의 통지를 받은 경우를 말한다. <개정 2007.6.29>
(2) The "cases where the likelihood of job loss is high" in Article 11 (2) 1 of the Act means cases where the person has been given a notice of dismissal under Article 26 of the Labor Standards Act or has received notice of dismissal by a method equivalent thereto.
③법 제11조제2항제1호에서 "근로시간이 대통령령으로 정하는 시간 이상 단축되는 경우"란 2개월 이상의 기간 동안 주당 평균 근로시간이 「근로기준법」에 따른 소정근로시간 미만이고, 그 직전 6개월의 주당 평균 근로시간에 비하여 100분의 30 이상 단축되는 경우를 말한다. <개정 2007.6.29, 2008.6.20, 2022.4.19>
(3) The "cases where working hours are reduced by the hours prescribed by Presidential Decree or more" in Article 11 (2) 1 of the Act means cases where, for a period of two months or more, average weekly working hours are less than the prescribed working hours under the Labor Standards Act and are reduced by 30 percent or more compared with average weekly working hours for the preceding six months.
④법 제11조제2항제1호에서 "단축될 가능성이 높은 경우"라 함은 제3항의 근로시간 단축이 포함된 「노동조합 및 노동관계조정법」에 따른 단체협약 또는 「근로기준법」에 따른 근로계약이 체결되거나 「근로기준법」에 따른 취업규칙, 그 밖에 이에 준하는 방식에 의하여 근로시간의 단축이 예정된 경우를 말한다. <개정 2009.10.19>
(4) The "cases where the likelihood of reduction is high" in Article 11 (2) 1 of the Act means cases where a collective agreement under the Trade Union and Labor Relations Adjustment Act or an employment contract under the Labor Standards Act including the reduction of working hours under paragraph (3) has been concluded, or a reduction of working hours is scheduled by rules of employment under the Labor Standards Act or other equivalent means.
⑤법 제11조제2항제2호나목에서 "통상변화대응지원기업에 납품을 하는 기업"이라 함은 다음 각 호의 어느 하나에 해당하는 매출액 또는 생산량이 해당 기업의 전체 매출액 또는 생산량 중 100분의 20 이상을 차지하는 기업을 말한다. <개정 2008.6.20, 2024.12.10>
(5) The "enterprises that supply goods to trade change response support enterprises" in Article 11 (2) 2 (b) of the Act means enterprises for which sales or production volume falling under any of the following accounts for 20 percent or more of the enterprise's total sales or production volume:
1. 통상변화대응지원기업이 생산하는 상품의 제조를 위하여 공급한 원료 또는 중간재
1. Raw materials or intermediate goods supplied for manufacturing products produced by trade change response support enterprises;
2. 통상변화대응지원기업이 생산하는 상품의 조립, 포장 등 추가적ㆍ부가가치적 업무
2. Additional and value-added work such as assembly and packaging of products produced by trade change response support enterprises.
