토양환경보전법 시행령 제8조의3(시정명령 등)

① 특별자치시장ㆍ특별자치도지사ㆍ시장ㆍ군수ㆍ구청장은 법 제14조제1항에 따라 특정토양오염관리대상시설의 설치자에게 토양오염방지시설의 설치 또는 개선이나 토양정밀조사의 실시를 명하는 때에는 제8조에 따른 토양오염검사의 결과와 특정토양오염관리대상시설의 종류ㆍ규모 등을 고려하여 6개월의 범위에서 그 이행기간을 정해야 한다. 다만, 조사지역의 규모 등으로 인하여 부득이하게 이행기간 내에 명령을 이행하기 어려운 사유가 있는 자에 대해서는 6개월의 범위에서 1회에 한정하여 그 이행기간을 연장할 수 있다. <개정 2011.9.30, 2018.11.20, 2021.1.5>

② 특별자치시장ㆍ특별자치도지사ㆍ시장ㆍ군수ㆍ구청장은 법 제14조제1항에 따라 특정토양오염관리대상시설의 설치자에게 오염토양의 정화조치를 명하는 경우에는 2년의 범위에서 그 이행기간을 정하여야 한다. 다만, 공사의 규모ㆍ공법 등으로 인하여 부득이하게 이행기간 내에 정화조치를 이행하기 어려운 사유가 있는 자에 대해서는 매회 1년의 범위에서 2회까지 그 이행기간을 연장할 수 있다. <개정 2011.9.30, 2018.11.20>
