택지개발촉진법 시행령 제9조의2(공공시행자의 택지 활용비율 등)

① 법 제12조제5항에서 "대통령령으로 정하는 비율 이상의 토지"란 택지개발지구의 전체 토지면적의 100분의 30 이상인 토지를 말한다. 이 경우 택지개발지구의 전체 토지면적 중 수용한 토지의 면적에 해당하는 비율 이상의 토지가 공공시행자가 택지로 활용하는 토지에 포함되어야 한다.

② 공공시행자와 주택건설등 사업자 간의 택지의 활용비율은 택지개발지구의 전체 토지면적에서 공공시행자와 주택건설등 사업자가 각각 확보한 토지면적의 비율 등을 고려하여 정하되, 구체적인 사항은 협약으로 정한다.

③제2항에도 불구하고 법 제12조제5항에 따라 택지개발지구의 전체 토지면적에서 주택건설등 사업자가 확보한 비율의 토지 중 일부를 공공시행자가 택지로 활용하는 경우의 비용의 정산은 다음의 계산식에 따라 산정한 금액을 기준으로 하되, 구체적인 사항은 협약으로 정한다.주택건설등 사업자가 취득한 토지의 공시지가 × (공공시행자가 수용한 토지의 보상액 ÷ 공공시행자가 수용한 토지의 공시지가) × (주택건설등 사업자가 확보한 비율의 토지 중 공공시행자가 택지로 활용하는 토지의 면적 ÷ 주택건설등 사업자가 취득한 토지의 면적)
