축산물 위생관리법 제9조의4(인증의 취소 등)
Livestock Products Sanitary Control Act, Article 9-4 (Revocation of Certification, etc.)
식품의약품안전처장은 안전관리인증작업장등이 다음 각 호의 어느 하나에 해당하면 총리령으로 정하는 바에 따라 시정을 명하거나 그 인증을 취소할 수 있다. 다만, 제1호 또는 제5호에 해당하는 경우에는 그 인증을 취소하여야 한다. <개정 2016.2.3, 2017.10.24, 2018.3.13, 2020.4.7, 2021.12.21>
Where a safety management certified workplace, etc. falls under any of the following, the Minister of Food and Drug Safety may order correction or revoke its certification, as prescribed by Ordinance of the Prime Minister: Provided, That the certification shall be revoked in cases falling under subparagraph 1 or 5:
1. 거짓이나 그 밖의 부정한 방법으로 인증을 받은 경우
1. Where certification was obtained by false or other improper means;
2. 안전관리인증기준을 지키지 아니한 경우
2. Where the safety management certification standards were not complied with;
3. 제9조제6항에 따른 변경 인증을 받지 아니하고 인증 사항을 변경한 경우
3. Where certified matters were changed without obtaining change certification under Article 9 (6);
4. 제4조제6항ㆍ제7항, 제5조제2항, 제12조제2항부터 제4항까지, 제18조 또는 제33조제1항을 위반하거나 제36조제1항 또는 제2항에 따른 명령을 위반하여 제27조에 따라 2개월 이상의 영업정지(영업의 일부정지는 제외한다) 명령을 받거나 그를 갈음하여 과징금 부과 처분을 받은 경우
4. Where an order of business suspension of two months or more (excluding partial business suspension) was issued under Article 27, or a penalty surcharge was imposed in lieu thereof, for violating Article 4 (6) or (7), Article 5 (2), Article 12 (2) through (4), Article 18, or Article 33 (1), or violating an order under Article 36 (1) or (2);
5. 총리령으로 정하는 바에 따라 1회 또는 2회 이상의 시정명령을 받고도 이를 이행하지 아니한 경우
5. Where a corrective order was received once or twice or more, as prescribed by Ordinance of the Prime Minister, and was not complied with;
6. 제9조의3제1항ㆍ제6항에 따른 출입ㆍ조사ㆍ평가를 거부ㆍ방해 또는 기피한 경우
6. Where entry, investigation, or evaluation under Article 9-3 (1) or (6) was refused, obstructed, or evaded;
7. 「식품 등의 표시ㆍ광고에 관한 법률」 제8조제1항을 위반하여 같은 법 제16조제1항 또는 제3항에 따라 2개월 이상의 영업정지(영업의 일부정지는 제외한다) 명령을 받거나 그를 갈음하여 과징금 부과 처분을 받은 경우
7. Where an order of business suspension of two months or more (excluding partial business suspension) was issued under Article 16 (1) or (3) of the Act on Labeling and Advertising of Food, etc., or a penalty surcharge was imposed in lieu thereof, for violating Article 8 (1) of that Act;
8. 그 밖에 제2호ㆍ제4호에 준하는 경우로서 총리령으로 정하는 경우
8. Other cases prescribed by Ordinance of the Prime Minister that are equivalent to subparagraph 2 or 4.
