총포ㆍ도검ㆍ화약류 등의 안전관리에 관한 법률 시행규칙 제31조(화약류양도ㆍ양수의 허가신청)

①법 제21조제1항 본문의 규정에 의하여 화약류를 양도 또는 양수하고자 하는 사람은 사용지가 특정된 경우에는 사용지를 관할하는 경찰서장의, 사용지가 특정되지 아니한 경우에는 양수하고자 하는 사람의 주소지(법인인 경우에는 주된 사무소의 소재지)를 관할하는 경찰서장의 허가를 받아야 한다. <개정 1996.7.29>

②제1항의 규정에 의한 화약류의 양도 또는 양수의 허가신청은 별지 제16호서식의 화약류 양도ㆍ양수허가신청서에 의하되, 다음 각호의 서류를 첨부하여야 한다. <개정 1996.7.29>

③양수허가의 유효기간은 1년을 초과할 수 없으며, 1회에 허가할 수 있는 화약류의 수량은 화약류 사용계획서에 기재된 그 연도의 1년간의 사용량을 초과할 수 없다.

④화약류를 양도할 때 양도인은 양수인이 소지하는 별지 제39호서식의 화약류 양도ㆍ양수허가증 뒤쪽의 양도인ㆍ양수인기재란에, 화약류를 양수할 때 양수인은 양도인이 소지하는 별지 제39호서식의 화약류 양도ㆍ양수허가증 뒤쪽의 양도인ㆍ양수인기재란에 정해진 사항을 각각 기재해야 한다. <신설 1996.7.29, 2021.12.31>
