초ㆍ중등교육법 시행령 제43조의2(교육과정 영향 사전협의의 범위 및 방법 등)

① 중앙행정기관의 장은 법 제23조의2제1항에 따라 교육과정에 교육실시 등이 의무적으로 부과되는 법정교육을 반영하는 내용의 법령을 제정하거나 개정하려는 경우에는 해당 법령안을 입법예고하기 전에 다음 각 호의 사항에 대해 국가교육위원회와 협의해야 한다.

② 중앙행정기관의 장은 제1항에 따라 국가교육위원회에 협의를 요청하기 전에 같은 항 각 호의 사항에 대해 「지방교육자치에 관한 법률」 제42조제1항에 따른 교육감 협의체의 의견을 서면으로 들어야 한다.

③ 국가교육위원회는 제1항에 따른 협의 요청이 있은 날부터 90일 이내에 그 심의ㆍ의결 결과를 협의를 요청한 중앙행정기관의 장에게 통보해야 한다. 다만, 부득이한 사유로 그 기간 내에 심의ㆍ의결하지 못했을 때에는 60일의 범위에서 그 기간을 연장할 수 있다.

④ 중앙행정기관의 장은 제3항에 따른 국가교육위원회의 심의ㆍ의결 결과를 입법예고하는 법령안에 반영하여야 한다.
