청원경찰법 제10조의5(배치의 폐지 등)

① 청원주는 청원경찰이 배치된 시설이 폐쇄되거나 축소되어 청원경찰의 배치를 폐지하거나 배치인원을 감축할 필요가 있다고 인정하면 청원경찰의 배치를 폐지하거나 배치인원을 감축할 수 있다. 다만, 청원주는 다음 각 호의 어느 하나에 해당하는 경우에는 청원경찰의 배치를 폐지하거나 배치인원을 감축할 수 없다. <개정 2014.12.30>

② 제1항에 따라 청원주가 청원경찰을 폐지하거나 감축하였을 때에는 청원경찰 배치 결정을 한 경찰관서의 장에게 알려야 하며, 그 사업장이 제4조제3항에 따라 시ㆍ도경찰청장이 청원경찰의 배치를 요청한 사업장일 때에는 그 폐지 또는 감축 사유를 구체적으로 밝혀야 한다. <개정 2020.12.22>

③ 제1항에 따라 청원경찰의 배치를 폐지하거나 배치인원을 감축하는 경우 해당 청원주는 배치폐지나 배치인원 감축으로 과원(過員)이 되는 청원경찰 인원을 그 기관ㆍ시설 또는 사업장 내의 유사 업무에 종사하게 하거나 다른 시설ㆍ사업장 등에 재배치하는 등 청원경찰의 고용이 보장될 수 있도록 노력하여야 한다. <신설 2014.12.30>
