별제권자가 최후의 배당에 관한 배당제외기간 안에 파산관재인에 대하여 그 권리포기의 의사를 표시하지 아니하거나 그 권리의 행사에 의하여 변제를 받을 수 없었던 채권액을 증명하지 아니한 때에는 배당에서 제외된다.
