채무자 회생 및 파산에 관한 법률 제407조의2(수탁자에 대한 파산절차에서의 환취권에 관한 특칙)

① 「신탁법」에 따라 신탁이 설정된 후 수탁자가 파산선고를 받은 경우 신탁재산을 환취하는 권리는 신수탁자 또는 신탁재산관리인이 행사한다.

② 신탁이 종료된 경우에는 「신탁법」 제101조에 따라 신탁재산이 귀속된 자가 제1항의 권리를 행사한다.
