채무자 회생 및 파산에 관한 법률 제145조(상계의 금지)

Debtor Rehabilitation and Bankruptcy Act, Article 145 (Prohibition of Set-Off)

다음 각호의 어느 하나에 해당하는 때에는 상계하지 못한다.

1. 회생채권자 또는 회생담보권자가 회생절차개시 후에 채무자에 대하여 채무를 부담한 때

2. 회생채권자 또는 회생담보권자가 지급의 정지, 회생절차개시의 신청 또는 파산의 신청이 있음을 알고 채무자에 대하여 채무를 부담한 때. 다만, 다음 각목의 어느 하나에 해당하는 때를 제외한다.

가. 그 부담이 법률에 정한 원인에 기한 때

나. 회생채권자 또는 회생담보권자가 지급의 정지, 회생절차개시의 신청 또는 파산의 신청이 있은 것을 알기 전에 생긴 원인에 의한 때

다. 회생절차개시시점 및 파산선고시점 중 가장 이른 시점보다 1년 이상 전에 생긴 원인에 의한 때
