지방자치법 시행령 제35조(의정비심의회의 운영 등)

① 의정비심의회는 그 의정비심의회가 구성된 해의 10월 31일까지 다음 해부터 임기만료에 의한 지방의회의원 선거가 있는 해까지 적용할 법 제40조제1항 각 호에 따른 금액을 결정해야 한다.

② 의정비심의회는 재적위원 3분의 2 이상의 찬성으로 의결한다.

③ 의정비심의회는 제1항에 따라 결정된 금액을 지체 없이 해당 지방자치단체의 장과 지방의회의 의장에게 통보해야 한다.

④ 제3항에 따른 통보를 받은 지방자치단체의 장은 그 통보받은 사항을 지체 없이 의정비심의회의 위원명단 및 회의록과 함께 해당 지방자치단체의 인터넷 홈페이지 등에 게재해야 한다.

⑤ 의정비심의회는 제1항에 따른 금액을 결정하기 위하여 공청회를 실시하거나 객관적이고 공정한 여론조사기관을 통하여 지역주민의 의견을 수렴하고, 그 결과를 반영해야 한다. 다만, 의정비심의회가 지방공무원의 보수가 인상되는 해의 인상률 범위에서 월정수당을 인상하려는 경우에는 공청회 개최나 의견 수렴을 생략할 수 있다.

⑥ 의정비심의회는 지방자치단체의 장이나 지방의회의 의장에게 제1항에 따른 금액의 결정에 필요한 자료의 제출이나 관계자의 설명을 요청할 수 있다.

⑦ 의정비심의회의 회의는 공개해야 한다. 다만, 출석위원 3분의 2 이상이 찬성한 경우에는 공개하지 않을 수 있다.

⑧ 의정비심의회에 참석한 위원에게는 해당 지방자치단체 예산의 범위에서 수당과 여비를 지급할 수 있다.

⑨ 제1항부터 제8항까지에서 규정한 사항 외에 의정비심의회의 구성 및 운영에 필요한 사항은 해당 지방자치단체의 조례로 정한다.
