지방자치법 시행령 제16조(청구인명부의 제출)

① 주민감사청구대표자는 청구인명부에 서명한 주민의 수가 법 제21조제1항에 따라 지방자치단체의 조례로 정하는 수 이상이 되면 제13조제7항에 따른 서명 요청 기간이 지난 날부터 시ㆍ도의 경우 10일 이내에 주무부장관에게, 시ㆍ군ㆍ자치구의 경우 5일 이내에 시ㆍ도지사에게 청구인명부를 제출해야 한다. 다만, 제14조제1항에 따른 전자서명의 경우에는 주민감사청구대표자가 주무부장관이나 시ㆍ도지사에게 정보시스템에 생성된 청구인명부를 직접 활용하도록 요청해야 한다.

② 제1항에 따라 청구인명부가 제출되면 주무부장관이나 시ㆍ도지사는 주민감사청구대표자의 성명ㆍ주소, 청구 취지 및 이유, 연서(連署) 주민 수, 청구인명부 열람기간ㆍ장소와 이의신청 방법 등을 공표해야 한다.
