지방자치단체 출자ㆍ출연 기관의 운영에 관한 법률 제9조(임원)

① 출자ㆍ출연 기관에는 임원으로 기관장을 포함한 이사와 감사(감사위원회를 포함한다. 이하 이 조에서 같다)를 둔다. 다만, 이사와 감사를 제외한 임원은 출자ㆍ출연 기관별 형태, 특성과 업무내용을 고려하여 정관으로 정한다.

② 출자ㆍ출연 기관의 임원(지방자치단체 소속 공무원이 당연직인 경우는 제외한다)은 공개모집을 통한 경쟁의 방식으로 임명한다.

(2) Officers오^f퍼서즈 of어^v브 a어 funded^f펀디드 or오 endowed엔다우드 institution인스티투션 (excluding익스클루딩 cases케이시즈 where웨어 a어 public퍼블릭 official어^f피실 of어^v브 the^ð더 local로우클 government거^v버먼트 serves서^v브즈 ex엑스 officio)어^f피시오 shall섈 be비 appointed어포인티드 by바이 competition캄퍼티션 through^θ쓰^r루 open오우픈 recruitment.^r러크^r룻먼트

③ 출자ㆍ출연 기관의 임원은 법령과 정관 등으로 정하는 바에 따라 그 의무와 책임에 관한 다음 각 호의 사항을 준수하여야 한다.

(3) Officers오^f퍼서즈 of어^v브 a어 funded^f펀디드 or오 endowed엔다우드 institution인스티투션 shall섈 comply컴플라이 with위^ð드 the^ð더 following^f팔로잉 matters매터즈 concerning컨서닝 their^ð데어 duties두티즈 and앤드 responsibilities,^r리스판서빌러티즈 as애즈 prescribed프^r리스크^r라이브드 by바이 statutes스태춧츠 and앤드 articles아터클즈 of어^v브 incorporation:인코퍼^r레이션

④ 주무기관의 장이나 지방자치단체의 장은 임원이 제3항에 따른 의무와 책임을 이행하지 아니하거나 이를 게을리한 경우 심의위원회의 심의ㆍ의결을 거쳐 그 임원을 해임하거나 그 임명권자에게 해임을 요구할 수 있고, 그 출자ㆍ출연 기관으로 하여금 손해배상을 청구하도록 요구할 수 있다.

⑤ 출자ㆍ출연 기관의 장은 그 기관의 이익과 자신의 이익이 상반되는 사항에 대하여 출자ㆍ출연 기관을 대표하지 못한다. 이 경우 감사가 출자ㆍ출연 기관을 대표한다.
