지방자치단체의 개방형직위 및 공모직위의 운영 등에 관한 규정 제6조(개방형직위 선발시험위원회)

① 임용권자(선발시험을 다른 기관에 위탁한 경우에는 그 기관의 장을 말한다)는 제5조제2항에 따른 시험을 실시하는 경우에는 임용예정 직위별로 5명 이상의 시험위원으로 선발시험위원회를 구성하여야 한다.

② 시험위원은 임용예정 직위와 관련된 분야 또는 채용ㆍ면접 등 시험에 관한 경험과 지식이 풍부한 사람 중에서 해당 인사위원회가 임명하거나 위촉하되, 시험위원의 3분의 2 이상은 민간위원(국공립 대학의 교원을 포함한다)이어야 하며, 위원장은 민간위원 중에서 위촉하여야 한다. <개정 2014.4.15>

③ 제2항에 따른 위원이 다음 각 호의 어느 하나에 해당하는 경우에는 선발시험위원회의 심의ㆍ의결에서 제척(除斥)된다. <신설 2020.12.8>

④ 개방형직위 선발시험 대상자는 위원에게 제3항 각 호의 제척사유가 있거나 공정(公正)한 심의ㆍ의결을 기대하기 어려운 사정이 있는 경우에는 그 이유를 분명하게 밝혀 그 위원의 기피 신청을 할 수 있으며, 위원은 심의ㆍ의결을 회피해야 한다. <신설 2020.12.8>

⑤ 제4항의 기피신청이 있는 경우에는 선발시험위원회의 의결로 해당 위원의 기피 여부를 결정해야 한다. 이 경우 기피신청을 받은 위원은 그 의결에 참여하지 못한다. <신설 2020.12.8>

⑥ 선발시험위원회는 제1항에 따른 구성원 3분의 2 이상 출석으로 개의(開議)하고, 출석위원 과반수 찬성으로 의결한다. <신설 2020.12.8>

⑦ 제1항부터 제6항까지에서 규정한 사항 외에 선발시험위원회의 운영 등에 필요한 사항은 지방자치단체의 장(시ㆍ도의 교육감을 포함한다)과 지방의회의 의장(시ㆍ도의회의 의장과 시ㆍ군ㆍ자치구의회의 의장을 말한다. 이하 같다)이 정한다. <신설 2020.12.8, 2021.11.30>
