지방자치단체를 당사자로 하는 계약에 관한 법률 시행령 제85조(긴급한 재해복구공사 등의 개산계약 이행방법)

① 지방자치단체의 장 또는 계약담당자는 긴급한 재해복구공사의 개산계약을 이행할 때 해당 공사의 설계 등 용역 계약상대자에게 공정별 우선순위에 따라 구분하여 설계서(실시 설계서를 포함한다. 이하 이 조에서 같다)를 작성하게 할 수 있다.

② 지방자치단체의 장 또는 계약담당자는 제1항에 따라 공정별 우선순위에 따라 구분하여 설계서가 작성된 경우 시공 계약상대자에게 공정별 우선순위에 따라 해당 공사를 우선 시공하게 할 수 있다.

③ 제2항에 따라 공정별 우선순위에 따라 해당 공사를 우선 시공하게 하는 경우 시공 계약상대자는 그 공사를 시공하기 전에 공사에 투입되는 자재ㆍ장비 등의 수량 및 규격ㆍ품질 등에 대하여 그 공사의 설계자 및 설계용역의 검사자ㆍ감독자와 협의한 후 서면으로 공사감독자의 승인을 받아야 한다.
