Enforcement Decree of the Act on Contracts to Which a Local Government Is a Party, Article 64-2 (Goods Exempt from Inspection)
법 제17조제2항에 따라 검사를 하지 아니할 수 있는 물품은 다음 각 호와 같다. 다만, 국민의 생명 보호, 안전, 보건위생 등을 위하여 검사가 필요하거나, 불량 자재의 사용, 다수의 하자 발생, 관계 기관의 결함보상명령 등으로 해당 물품에 대한 품질의 확인이 필요한 경우에는 법 제17조제1항에 따른 검사를 하여야 한다. <개정 2016.7.28, 2016.9.13, 2017.1.26, 2020.9.29>
The goods that may be exempted from inspection pursuant to Article 17 (2) of the Act are as follows. However, where inspection is necessary to protect lives, safety, public health and hygiene, etc. of citizens, or where verification of the quality of the relevant goods is necessary owing to the use of defective materials, occurrence of many defects, an order for defect compensation by a relevant agency, etc., inspection under Article 17 (1) of the Act shall be conducted:
1. 「산업표준화법」 제15조에 따라 인증을 받은 제품
1. Products certified under Article 15 of the Industrial Standardization Act;
2. 「산업표준화법」 제31조의4제2항에 따라 수상자로 선정된 기업등 및 개인이 제조한 제품
2. Products manufactured by enterprises, etc. and individuals selected as winners under Article 31-4 (2) of the Industrial Standardization Act;
3. 「조달사업에 관한 법률」 제18조에 따라 조달청장이 정하여 고시한 품질관리기준에 적합한 자가 제조한 물품
3. Goods manufactured by a person conforming to quality management standards determined and publicly notified by the Administrator of the Public Procurement Service under Article 18 of the Act on Public Procurement Business.
