Enforcement Decree of the Act on Contracts to Which a Local Government Is a Party, Article 54 (Revenue-Recognition Measures for Performance Bonds)

① 지방자치단체의 장 또는 계약담당자는 계약상대자가 정당한 이유 없이 계약상의 의무를 이행하지 아니하면 제51조에 따른 계약보증금을 법 제15조제3항에 따라 지방자치단체에 세입조치하여야 한다. 다만, 다음 각 호의 어느 하나에 해당하는 경우에는 해당 호에서 정하는 금액을 제외한 금액을 세입조치 해야 한다. <개정 2023.3.7>

1. 성질상 분할할 수 있는 공사ㆍ물품 또는 용역 등에 관한 계약(법 제25조에 따른 단가계약은 제외한다)으로서 기성 부분 또는 기납 부분에 대한 검사를 거쳐 인수하거나 관리ㆍ사용하고 있는 경우: 당초의 계약보증금 중 기성 부분 또는 기납 부분에 해당하는 금액

② 장기계속계약에서 계약상대자가 제78조제2항 후단과 같은 조 제3항에 따른 2차 이후의 공사 또는 제조 등의 계약을 체결하지 아니한 경우에는 제1항을 준용한다.

③ 제1항과 제2항에 따라 계약보증금을 지방자치단체에 세입조치할 때 그 계약보증금은 기성(旣成) 부분에 대한 미지급액과 상계(相計) 처리해서는 아니 된다. 다만, 제53조에 따라 계약보증금이 면제되는 경우에는 그러하지 아니하다.
