① 지방자치단체의 장 또는 계약담당자는 기본설계 기술제안입찰을 하는 경우 입찰자에게 다음 각 호의 내용을 포함한 기술제안서를 제출하게 하여야 한다. 다만, 공사의 특성 등을 고려하여 필요하다고 인정하는 경우 그 내용의 일부를 변경할 수 있다. <개정 2011.9.15>

③ 지방자치단체의 장 또는 계약담당자는 다음 각 호의 어느 하나에 해당하는 때에는 지방건설기술심의위원회에 그 기술제안서 또는 실시설계서의 적격 여부에 대한 심의 및 점수 평가를 의뢰하여야 한다. 이 경우 지방건설기술심의위원회는 기술적 타당성을 검토하고 기술제안서 또는 실시설계서의 적격 여부를 명백히 한 서류 및 평가점수를 해당 지방자치단체의 장 또는 계약담당자에게 통지하여야 한다. <개정 2016.9.13>
