지방세특례제한법 시행령 제58조(기술비법의 범위 등)

① 법 제104조제1항 및 제2항에서 "대통령령으로 정하는 특수관계인"이란 「소득세법 시행령」 제98조제1항에 따른 특수관계인을 말한다.

② 법 제104조제1항에서 "대통령령으로 정하는 기술비법"이란 「조세특례제한법 시행령」 제11조제3항에 따른 기술비법을 말하고, "대통령령으로 정하는 기술"이란 「조세특례제한법 시행령」 제11조제4항에 따른 기술을 말한다. <개정 2015.2.3>

③ 법 제104조제3항을 적용받으려는 자는 과세표준신고와 함께 행정안전부령으로 정하는 세액감면신청서 또는 세액공제신청서를 납세지 관할 지방자치단체의 장에게 제출하여야 한다. 다만, 「조세특례제한법 시행령」 제11조제6항에 따라 납세지 관할 세무서장에게 소득세 감면 또는 공제를 신청하는 경우에는 법 제104조에 따른 개인지방소득세에 대한 세액감면 또는 세액공제도 함께 신청한 것으로 본다. <개정 2014.11.19, 2015.2.3, 2017.7.26>
