지방세징수법 제88조(입찰과 개찰)

① 입찰하려는 자는 주소 또는 거소, 성명, 매수하려는 재산의 명칭, 입찰가격, 공매보증금, 그 밖에 필요한 사항을 적어 개찰이 시작되기 전에 공매를 집행하는 공무원에게 제출하여야 한다.

② 개찰은 공매를 집행하는 공무원이 공개하여야 하고 각각 적힌 입찰가격을 불러 입찰조서에 기록하여야 한다.

③ 매각예정가격 이상의 최고액 입찰자를 낙찰자로 한다.

④ 낙찰이 될 가격의 입찰을 한 자가 둘 이상일 때에는 즉시 추첨으로 낙찰자를 정한다.

⑤ 제4항의 경우에 해당 입찰자 중 출석하지 아니한 자 또는 추첨을 하지 아니한 자가 있을 때에는 입찰 사무에 관계없는 공무원으로 하여금 대신 추첨하게 할 수 있다.

⑥ 매각예정가격 이상으로 입찰한 자가 없을 때에는 즉시 그 장소에서 재입찰에 부칠 수 있다.
