Enforcement Decree of the Local Tax Act, Article 83 (Business Places Discharging Pollutants)
법 제81조제1항제2호 단서에서 "대통령령으로 정하는 오염물질 배출 사업소"란 다음 각 호의 어느 하나에 해당하는 사업소로서 「지방세기본법」 제34조제1항에 따른 납세의무 성립일 이전 최근 1년 내에 행정기관으로부터 「물환경보전법」, 「대기환경보전법」 또는 「환경오염시설의 통합관리에 관한 법률」에 따른 개선명령ㆍ조업정지명령ㆍ사용중지명령 또는 폐쇄명령(이하 이 조에서 "개선명령등"이라 한다)을 받은 사업소(해당 법률에 따라 개선명령등을 갈음하여 과징금이 부과된 사업소를 포함한다)를 말한다. <개정 2016.12.30, 2017.12.29, 2018.1.16, 2020.12.31, 2021.12.31, 2023.6.30>
In the proviso to Article 81 (1) 2 of the Act, "business places prescribed by Presidential Decree as discharging pollutants" means business places falling under any of the following subparagraphs that, within the most recent one year before the date on which tax liability is established under Article 34 (1) of the Framework Act on Local Taxes, received from an administrative agency an improvement order, order to suspend operation, order to suspend use, or closure order under the Water Environment Conservation Act, the Clean Air Conservation Act, or the Act on the Integrated Control of Pollutant-Discharging Facilities (hereinafter referred to as "improvement order, etc." in this Article) (including business places on which a penalty surcharge was imposed in place of an improvement order, etc. under the relevant Act):
1. 「물환경보전법」 제33조에 따른 폐수배출시설 설치의 허가 또는 신고 대상 사업소로서 같은 법에 따라 배출시설 설치의 허가를 받지 아니하였거나 신고를 하지 아니한 사업소
1. A business place subject to permission for, or reporting of, the installation of wastewater discharge facilities under Article 33 of the Water Environment Conservation Act, which has not obtained permission for or reported the installation of the discharge facilities under the same Act;
2. 「물환경보전법」 제33조에 따른 폐수배출시설 설치의 허가를 받거나 신고를 한 사업소로서 해당 사업소에 대한 점검 결과 부적합 판정을 받은 사업소
2. A business place that has obtained permission for, or reported, the installation of wastewater discharge facilities under Article 33 of the Water Environment Conservation Act, which has been found noncompliant as a result of an inspection of the business place;
3. 「대기환경보전법」 제23조에 따른 대기오염물질배출시설 설치의 허가 또는 신고 대상 사업소로서 같은 법에 따라 배출시설 설치의 허가를 받지 아니하였거나 신고를 하지 아니한 사업소
3. A business place subject to permission for, or reporting of, the installation of air pollutant discharge facilities under Article 23 of the Clean Air Conservation Act, which has not obtained permission for or reported the installation of the discharge facilities under the same Act;
4. 「대기환경보전법」 제23조에 따른 대기오염물질배출시설 설치의 허가를 받거나 신고를 한 사업소로서 해당 사업소에 대한 점검 결과 부적합 판정을 받은 사업소
4. A business place that has obtained permission for, or reported, the installation of air pollutant discharge facilities under Article 23 of the Clean Air Conservation Act, which has been found noncompliant as a result of an inspection of the business place;
5. 「환경오염시설의 통합관리에 관한 법률」 제6조에 따른 배출시설등(같은 법 제2조제2호나목 및 사목의 배출시설로 한정한다. 이하 이 조에서 같다)의 설치ㆍ운영 허가 대상 사업소로서 해당 배출시설 설치ㆍ운영 허가를 받지 않은 사업소
5. A business place subject to permission for the installation and operation of discharge facilities, etc. under Article 6 of the Act on the Integrated Control of Pollutant-Discharging Facilities (limited to discharge facilities under Article 2 2 (b) and (g) of the same Act; the same applies hereinafter in this Article), which has not obtained permission for the installation and operation of the discharge facilities;
6. 「환경오염시설의 통합관리에 관한 법률」 제6조에 따른 배출시설등의 설치ㆍ운영 허가를 받은 사업소로서 해당 배출시설에 대한 점검 결과 부적합 판정을 받은 사업소
6. A business place that has obtained permission for the installation and operation of discharge facilities, etc. under Article 6 of the Act on the Integrated Control of Pollutant-Discharging Facilities, which has been found noncompliant as a result of an inspection of the discharge facilities.
