지방교육재정교부금법 시행령 제8조(전입금 세출예산 협의 등)

① 법 제11조제6항에 따른 협의는 「지방교육자치에 관한 법률」 제41조제1항에 따른 지방교육행정협의회를 통하여 실시한다. 이 경우 그 협의 사항에는 전입금의 전입시기가 포함되어야 한다. <개정 2016.12.30>

② 시ㆍ도의 교육감은 시ㆍ도의회에 예산안을 제출하기 30일 전까지 해당 시ㆍ도지사에게 제1항에 따른 협의를 위한 지방교육행정협의회의 개회를 요청하여야 한다. <개정 2022.11.1>

(2) The^ð더 superintendent수퍼^r런텐던트 of어^v브 education에저케이션 of어^v브 a어 Si/Do시 shall섈 request^r리퀘스트 the^ð더 relevant^r렐러^v번트 Mayor/Do메이어 Governor,거^v버너 at앳 least리스트 30 days데이즈 before비^f포 submitting서브미팅 the^ð더 budget버짓 bill빌 to투 the^ð더 Si/Do시 council,카운슬 to투 convene컨^v빈 the^ð더 local로우클 education에저케이션 administration애드미니스트^r레이션 council카운슬 for^f포 the^ð더 consultation칸설테이션 under언더 paragraph패^r러그^r래^f프 (1).

③ 시ㆍ도의 교육감과 시ㆍ도지사는 제2항에 따른 요청이 있은 날부터 10일 이내에 지방교육행정협의회를 통한 협의를 개시하고, 시ㆍ도의 교육감이 시ㆍ도의회에 예산안을 제출하기 5일 전까지 그 협의를 종료하여야 한다. <개정 2022.11.1>

(3) The^ð더 superintendent수퍼^r런텐던트 of어^v브 education에저케이션 and앤드 the^ð더 Mayor/Do메이어 Governor거^v버너 of어^v브 a어 Si/Do시 shall섈 commence커멘스 the^ð더 consultation칸설테이션 through^θ쓰^r루 the^ð더 local로우클 education에저케이션 administration애드미니스트^r레이션 council카운슬 within위^ð딘 10 days데이즈 from^f프^r럼 the^ð더 date데잇 of어^v브 the^ð더 request^r리퀘스트 under언더 paragraph패^r러그^r래^f프 (2), and앤드 shall섈 conclude컨클루드 the^ð더 consultation칸설테이션 at앳 least리스트 5 days데이즈 before비^f포 the^ð더 superintendent수퍼^r런텐던트 of어^v브 education에저케이션 submits서브밋츠 the^ð더 budget버짓 bill빌 to투 the^ð더 Si/Do시 council.카운슬

④ 시ㆍ도의 교육감은 시ㆍ도의회에 예산안을 제출하는 경우 제1항에 따른 협의의 결과를 첨부하여야 한다. <개정 2022.11.1>

⑤ 시ㆍ도의 교육감과 시ㆍ도지사는 특별한 사정이 없는 한 제1항에 따라 협의된 사항을 준수하여야 한다. <개정 2022.11.1>
