지방교육자치에 관한 법률 제34조(하급교육행정기관의 설치 등)

①시ㆍ도의 교육ㆍ학예에 관한 사무를 분장하기 위하여 1개 또는 2개 이상의 시ㆍ군 및 자치구를 관할구역으로 하는 하급교육행정기관으로서 교육지원청을 둔다. <개정 2013.12.30>

②교육지원청의 관할구역과 위치는 시ㆍ도의 조례로 정하고, 명칭은 대통령령으로 정하는 범위에서 시ㆍ도의 조례로 정한다. <개정 2013.12.30, 2025.11.11>

③ 교육감은 학교 교육의 효과적인 지원 및 교육지원청의 효율적인 운영을 위하여 필요한 경우에는 관계 지방의회, 주민, 학부모 등의 의견을 들어 교육지원청을 설치ㆍ폐지 또는 통합ㆍ분리할 수 있다. 이 경우 교육지원청의 변경사항은 해당 시ㆍ도의 조례로 정하고, 교육감은 그 결과를 교육부장관에게 알려야 한다. <신설 2025.11.11>

④교육지원청에 교육장을 두되 장학관으로 보하고, 그 임용에 관하여 필요한 사항은 대통령령으로 정한다. <개정 2013.12.30, 2025.11.11>
