지방교부세법 시행령 제13조(구역 변경과 폐지ㆍ설치ㆍ분리ㆍ병합의 경우)

1. 둘 이상의 지방자치단체가 합하여 새로운 지방자치단체가 설치된 경우: 종전의 지방자치단체에 교부할 보통교부세ㆍ부동산교부세 및 소방안전교부세를 그대로 새로운 지방자치단체에 교부

2. 지방자치단체의 구역이 변경되거나 하나의 지방자치단체가 둘 이상의 지방자치단체로 나누어진 경우: 새로운 지방자치단체에 교부할 보통교부세ㆍ부동산교부세 및 소방안전교부세는 종전의 그 지방자치단체에 교부할 보통교부세ㆍ부동산교부세 및 소방안전교부세를 기준으로 법 제6조부터 제8조까지, 제9조의3 및 제9조의4에 따라 다시 산정. 다만, 구역의 변경이 일부에 국한되거나 경미한 경우에는 다음 연도 교부세를 산정할 때에 조정할 수 있다.

3. 지방자치단체의 폐지ㆍ설치ㆍ분리ㆍ병합 또는 구역 변경이 있는 경우: 새로운 지방자치단체에 교부할 특별교부세는 법 제9조제1항 각 호의 요건을 고려하여 다시 산정
