지방공무원 수당 등에 관한 규정 제21조(정년퇴직공무원등에 대한 수당등의 지급)

①공무원이 「지방공무원법」 제46조의2ㆍ제66조제2항 또는 제66조의2의 규정에 의하여 정년퇴직ㆍ명예퇴직ㆍ조기퇴직 또는 자진퇴직하는 경우(그 달 1일자로 퇴직하는 경우를 제외한다)에는 「지방공무원보수규정」 제21조제1항의 규정에 불구하고 퇴직한 날이 속하는 달의 수당등(징계처분 그 밖의 사유로 수당등이 감액된 경우에는 감액된 금액)의 전액을 지급한다. <개정 2001.1.29, 2011.8.29, 2012.1.6>

② 공무원이 재직 중 공무로 사망하거나 공무상 질병 또는 부상으로 재직 중 사망하여 면직(그 달 1일자로 면직되는 경우는 제외한다) 또는 제적된 경우에는 「지방공무원 보수규정」 제21조제1항에도 불구하고 면직 또는 제적된 날이 속하는 달의 수당등(징계처분이나 그 밖의 사유로 수당등이 감액된 경우에는 감액된 금액)의 전액을 지급한다. <신설 2011.8.29>
