지방공무원 보수규정 제29조(면직 또는 징계처분등이 취소된 공무원의 보수지급)

①공무원에게 행한 징계처분ㆍ면직처분 또는 직위해제처분(징계의결의 요구에 따른 직위해제처분을 제외한다)이 무효ㆍ취소 또는 변경된 경우에는 복귀일 또는 발령일에 원래의 정기승급일을 기준으로 한 당시의 보수전액 또는 차액을 소급하여 지급한다. 이 경우 재징계절차에 의하여 징계처분한 경우에는 재징계처분에 따라 보수를 지급하되, 재징계처분전의 징계처분기간에 대하여는 보수의 전액 또는 차액을 소급하여 지급한다. <개정 2017.1.6>

② 공무원의 직위해제처분기간이 제14조제4호에 따라 승급기간에 산입되는 경우에는 원래의 정기승급일을 기준으로 한 보수와 그 직위해제처분기간 중에 지급한 보수와의 차액을 소급하여 지급한다. <개정 2016.6.28>

③ 제1항 및 제2항에 따라 보수의 전액 또는 차액을 소급하여 지급하는 경우 수당의 소급 지급에 대해서는 같은 항의 규정에도 불구하고 「지방공무원 수당 등에 관한 규정」 제19조제7항에 따른다. <신설 2016.6.28>
