지방공무원법 제41조의4(장학금 지급)

① 지방자치단체의 장은 우수한 공무원을 확보하기 위하여 필요하면 「초ㆍ중등교육법」, 「고등교육법」, 그 밖의 법률에 따라 설치된 각급학교(기능대학과 학위과정이 설치된 교육기관을 포함한다)의 재학생으로서 공무원으로 임용되기를 원하는 사람에게 장학금을 지급하고 졸업 후 일정한 의무복무 기간을 부과하여 공무원으로 근무하게 할 수 있다.

② 제1항에 따라 장학금을 받은 사람이 본인에게 책임이 있는 사유로 장학금 지급이 중단되거나 공무원으로 임용되지 아니한 경우 또는 의무복무 기간을 마치지 아니하고 퇴직한 경우에는 본인에게 지급한 장학금의 전부 또는 일부의 반납을 명하거나 본인이 반납하지 아니할 경우 그의 보증인(「보험업법」에 따라 보증보험증권을 발행한 보험회사를 포함한다)에게 보증채무의 이행을 청구할 수 있으며, 이를 이행하지 아니하면 지방세 체납처분의 예에 따라 징수할 수 있다. 다만, 대통령령으로 정하는 불가피한 사유가 있을 때에는 그러하지 아니하다. <개정 2021.10.8>

③ 장학금으로 지급될 학비의 범위, 지급 대상, 채용방법, 의무복무 기간, 의무 불이행 시 환수할 금액, 그 밖에 필요한 사항은 대통령령으로 정한다. 이 경우 의무복무 기간은 장학금을 받은 기간의 2배 이내에서 정하여야 한다.
