지방공기업법 제78조(경영평가 및 지도)

① 행정안전부장관은 제3조에 따른 지방공기업의 경영 기본원칙을 고려하여 대통령령으로 정하는 바에 따라 지방공기업에 대한 경영평가를 하고, 그 결과에 따라 필요한 조치를 하여야 한다. 다만, 행정안전부장관이 필요하다고 인정하는 경우에는 지방자치단체의 장으로 하여금 경영평가를 하게 할 수 있다. <개정 2013.3.23, 2013.6.4, 2014.11.19, 2017.7.26>

② 제1항에 따른 경영평가에는 지방공기업의 경영목표의 달성도, 업무의 능률성, 공익성, 고객서비스 등에 관한 평가가 포함되어야 한다.

③ 행정안전부장관은 제1항에 따른 경영평가를 위하여 필요한 경우 지방공기업에 고객 명부 등 관련 자료의 제출을 요청할 수 있다. 이 경우 요청을 받은 지방공기업은 정당한 사유가 없는 한 이에 따라야 한다. <신설 2013.6.4, 2014.11.19, 2017.7.26>

④ 행정안전부장관은 대통령령으로 정하는 바에 따라 제1항 및 제2항에 따른 경영평가와는 별도로 사장에 대하여 업무성과 평가를 할 수 있다. 이 경우 공익성이 고려되어야 한다. <개정 2013.3.23, 2013.6.4, 2014.11.19, 2017.7.26>

⑤ 행정안전부장관 또는 시ㆍ도지사(특별자치시장 및 특별자치도지사는 제외한다. 이하 이 항에서 같다)는 지방공기업(시ㆍ도지사의 경우에는 시ㆍ군ㆍ자치구의 지방공기업으로 한정한다)의 효율적인 경영을 위하여 필요한 지도, 조언 또는 권고를 할 수 있다. <개정 2013.3.23, 2013.6.4, 2014.11.19, 2017.7.26>

⑥ 행정안전부장관은 지방공기업이 다음 각 호의 어느 하나에 해당하는 경우에는 제1항에 따른 경영평가 결과를 조정하고, 해당 지방공기업에 대한 주의ㆍ경고 등의 조치를 하거나 지방자치단체의 장에게 해당 지방공기업의 평가급 조정을 요청할 수 있다. 이 경우 제78조의5에 따른 지방공기업정책위원회의 심의를 거쳐야 한다. <신설 2022.1.11>

⑦ 제6항에 따른 요청을 받은 지방자치단체의 장은 특별한 사정이 없으면 해당 지방공기업의 평가급을 조정하여야 하고, 필요한 경우 해당 공사의 사장 또는 공단의 이사장에게 관련자에 대한 인사상의 조치 등을 요구할 수 있다. <신설 2022.1.11>
