지뢰피해자 지원에 관한 특별법 제4조(위로금)

① 피해자 또는 그 유족에게는 다음 각 호의 구분에 따라 산출한 금액에 사망한 날 또는 상이를 입은 날부터 보상결정이 있은 날까지의 법정이율에 따른 이자를 가산한 위로금을 지급한다.

② 피해자 중 상이를 입은 사람이 그 상이 외의 원인으로 사망한 경우에는 그 유족에게 제1항제2호에 따라 산정한 위로금을 지급한다. 이 경우 제1항제2호나목의 "장래의 취업가능기간"을 "상이를 입은 때부터 사망한 때까지의 기간"으로 본다.

③ 월평균임금은 주소지를 관할하는 시장ㆍ군수ㆍ구청장 또는 세무서장의 증명이나 그 밖의 공신력 있는 증명에 따라 산출하고 이를 증명할 수 없을 때에는 대통령령으로 정하는 바에 따른다.

④ 제1항에 따라 유족에게 지급할 위로금을 산정할 때에는 월평균임금에서 대통령령으로 정하는 생활비를 공제하여야 한다.

⑤ 제1항에 따른 취업가능기간ㆍ장해등급ㆍ노동력상실률 및 단할인법에 따른 중간이자 공제방법에 관하여는 대통령령으로 정한다.

⑥ 제1항에 따라 사망 또는 상이를 입을 당시의 월평균임금을 기준으로 산정한 위로금이 2천만원에 이르지 아니할 경우 이를 2천만원을 초과하지 아니하는 범위에서 피해자의 취업가능기간 및 장해정도 등을 고려하여 대통령령으로 정하는 바에 따라 조정ㆍ지급할 수 있다. <신설 2016.3.22>
