중소기업협동조합법 제50조(임원)

①조합에는 임원으로 이사장 1명, 이사 5명 이상, 상근 이사 1명과 감사 2명 이하를 둔다. 이 경우 상근 이사의 명칭에 관하여는 정관으로 정할 수 있다.

② 상근 이사 외 임원은 총회에서 정관으로 정하는 바에 따라 조합원 중에서 선출한다. <개정 2018.3.13>

③ 이사장, 이사 또는 감사로 선출되고자 하는 조합원은 그 선출되고자 하는 이사장ㆍ이사 또는 감사의 임기 종료일(보궐선거 등에서는 그 선거의 실시 사유가 확정된 날) 6개월 전부터 그 선거일까지 계속하여 해당 조합의 조합원이어야 한다. <신설 2018.3.13>

④ 설립등기를 한 날부터 6개월이 경과하지 아니한 조합에서 이사장ㆍ이사 또는 감사를 선출할 경우에는 제3항을 적용하지 아니한다. <신설 2018.3.13>

⑤ 제13조제2항 및 제3항에 따라 가입한 조합원에 대하여는 정관으로 정하는 바에 따라 이사장 입후보의 자격을 제한할 수 있다. <신설 2015.2.3, 2018.3.13>
