중소기업기술 보호 지원에 관한 법률 시행령 제12조(중소기업기술분쟁조정ㆍ중재위원회의 구성 및 운영)

① 법 제23조제1항에 따라 중소기업기술 보호와 관련된 분쟁을 조정ㆍ중재하기 위하여 중소벤처기업부장관 소속으로 두는 중소기업기술분쟁조정ㆍ중재위원회(이하 "위원회"라 한다)의 위원장(이하 "위원장"이라 한다)은 위원회의 회의를 소집하며, 그 의장이 된다. <개정 2017.7.26>

(1) The^ð더 chairperson체어퍼슨 (hereinafter히^r리내^f프터 referred^r러^f퍼드 to투 as애즈 the^ð더 "chairperson")체어퍼슨 of어^v브 the^ð더 Small스몰 and앤드 Medium미디엄 Enterprise엔터프^r라이즈 Technology텍날러지 Dispute디스퓻 Mediation미디에이션 and앤드 Arbitration아비트^r레이션 Committee커미티 (hereinafter히^r리내^f프터 referred^r러^f퍼드 to투 as애즈 the^ð더 "Committee"),커미티 established이스태블리시트 under언더 the^ð더 Minister미너스터 of어^v브 SMEs스메즈 and앤드 Startups스타텁스 under언더 Article아터클 23 (1) of어^v브 the^ð디 Act액트 to투 mediate미디에잇 and앤드 arbitrate아버트^r레잇 disputes디스퓻츠 related^r릴레이티드 to투 protection프^r러텍션 of어^v브 technology텍날러지 of어^v브 small스몰 and앤드 medium미디엄 enterprises,엔터프^r라이지즈 shall섈 convene컨^v빈 meetings미팅즈 of어^v브 the^ð더 Committee커미티 and앤드 serve서^v브 as애즈 its잇츠 chair.체어

② 위원장이 부득이한 사유로 그 직무를 수행할 수 없을 때에는 위원장이 미리 지명한 위원의 순서로 그 직무를 대행한다.

(2) Where웨어 the^ð더 chairperson체어퍼슨 is이즈 unable어네이블 to투 perform퍼^f폼 duties두티즈 due두 to투 unavoidable어너^v보이더블 reasons,^r리즌즈 a어 member멤버 shall섈 act액트 on안 the^ð더 chairperson's체어퍼슨즈 behalf비해^f프 in인 the^ð디 order오더 designated데지그네이티드 in인 advance어드^v밴스 by바이 the^ð더 chairperson.체어퍼슨

③ 위원장이 회의를 소집하려면 회의 개최 7일 전까지 회의의 일시, 장소 및 안건을 각 위원에게 서면으로 알려야 한다. 다만, 긴급한 사정이나 그 밖의 부득이한 사유가 있는 경우에는 회의 개최 전날까지 구두로 알릴 수 있다.

④ 위원회에 출석한 위원에게는 예산의 범위에서 수당과 여비를 지급할 수 있다. 다만, 공무원인 위원이 그 소관 업무와 직접적으로 관련되어 출석하는 경우에는 수당과 여비를 지급하지 아니한다.
