주택법 시행령 제74조의2(공급질서 교란 행위로 인한 주택 공급계약 취소제한 및 취소절차 등)

① 법 제65조제6항에서 "대통령령으로 정하는 바에 따라 소명하는 경우"란 매수인이 법 제65조제1항을 위반한 공급질서 교란 행위(이하 이 조에서 "공급질서교란행위"라 한다)와 관련이 없음을 제5항에 따라 시장ㆍ군수ㆍ구청장으로부터 확인받은 경우를 말한다.

② 국토교통부장관 또는 사업주체는 매수인이 취득한 주택이나 주택의 입주자로 선정된 지위(이하 이 조에서 "주택등"이라 한다)가 법 제65조제1항을 위반하여 공급받은 것으로 판단되는 경우에는 지체 없이 해당 주택의 소재지(법 제49조에 따른 사용검사를 받기 전인 경우에는 주택건설대지로 한다)를 관할하는 시장ㆍ군수ㆍ구청장에게 그 사실을 통보해야 한다. 이 경우 국토교통부장관은 사업주체에게, 사업주체는 국토교통부장관에게도 함께 통보해야 한다.

③ 제2항에 따라 관할 시장ㆍ군수ㆍ구청장에게 통보하거나 국토교통부장관으로부터 통보받은 사업주체는 매수인이 공급질서교란행위와 관련이 없음을 제2항에 따른 시장ㆍ군수ㆍ구청장에게 소명할 것을 매수인에게 요구해야 한다.

④ 제3항에 따른 소명 요구를 받은 매수인은 요구받은 날부터 1개월 이내에 소명 내용을 적은 문서(전자문서를 포함한다)에 다음 각 호의 서류(전자문서를 포함한다)를 첨부하여 제2항에 따른 시장ㆍ군수ㆍ구청장에게 제출할 수 있다.

⑤ 제4항에 따른 소명 문서를 제출받은 시장ㆍ군수ㆍ구청장은 문서를 제출받은 날부터 2개월 이내에 소명 내용을 확인하여 매수인이 공급질서교란행위와 관련이 있는지를 국토교통부장관ㆍ사업주체 및 매수인에게 각각 통보해야 한다.

⑥ 사업주체는 법 제65조제2항에 따라 이미 체결된 주택의 공급계약을 취소하려는 경우 국토교통부장관과 주택등을 보유하고 있는 자에게 계약 취소 일정, 법 제65조제3항에 따른 주택가격에 해당하는 금액과 해당 금액의 지급 방법 등을 각각 문서로 미리 통보해야 한다.
