Enforcement Decree of the Housing Act, Article 22 (Replacement and New Admission of Members of Regional and Workplace Housing Associations)

① 지역주택조합 또는 직장주택조합은 설립인가를 받은 후에는 해당 조합원을 교체하거나 신규로 가입하게 할 수 없다. 다만, 다음 각 호의 어느 하나에 해당하는 경우에는 예외로 한다. <개정 2019.10.22>

1. 조합원 수가 주택건설 예정 세대수를 초과하지 아니하는 범위에서 시장ㆍ군수ㆍ구청장으로부터 국토교통부령으로 정하는 바에 따라 조합원 추가모집의 승인을 받은 경우

가. 조합원의 사망

(a)어 Death데^θ스 of어^v브 an앤 association어소우시에이션 member;멤버

나. 법 제15조에 따른 사업계획승인 이후[지역주택조합 또는 직장주택조합이 제16조제2항제2호 단서에 따라 해당 주택건설대지 전부의 소유권을 확보하지 아니하고 법 제15조에 따른 사업계획승인을 받은 경우에는 해당 주택건설대지 전부의 소유권(해당 주택건설대지가 저당권등의 목적으로 되어 있는 경우에는 그 저당권등의 말소를 포함한다)을 확보한 이후를 말한다]에 입주자로 선정된 지위(해당 주택에 입주할 수 있는 권리ㆍ자격 또는 지위 등을 말한다)가 양도ㆍ증여 또는 판결 등으로 변경된 경우. 다만, 법 제64조제1항제1호에 따라 전매가 금지되는 경우는 제외한다.

라. 조합원이 무자격자로 판명되어 자격을 상실하는 경우

마. 법 제15조에 따른 사업계획승인 등의 과정에서 주택건설 예정 세대수가 변경되어 조합원 수가 변경된 세대수의 50퍼센트 미만이 되는 경우
