주차장법 시행령 제10조(주차장 설치비용 납부자의 주차장 무상사용 등)

① 시장ㆍ군수 또는 구청장은 제9조에 따라 시설물의 소유자로부터 부설주차장의 설치에 필요한 비용을 받은 경우에는 시설물 준공검사확인증(건축물인 경우에는 「건축법」 제22조에 따른 사용승인서 또는 임시사용승인서를 말한다. 이하 같다)을 발급할 때에 특별시장ㆍ광역시장, 시장ㆍ군수 또는 구청장이 설치한 노외주차장 중 해당 시설물의 소유자가 무상으로 사용할 수 있는 주차장을 지정하여야 한다. 다만, 제7조제2항에 따른 범위에 해당하는 시설물의 부지 인근에 사용할 수 있는 노외주차장이 없는 경우에는 그러하지 아니하다.

② 제1항 본문에 따라 주차장을 무상으로 사용할 수 있는 기간은 납부된 주차장 설치비용을 해당 지방자치단체의 조례로 정하는 방법에 따라 시설물 준공검사확인증을 발급할 때의 해당 주차장의 주차요금 징수기준에 따른 징수요금으로 나누어 산정한다.

③ 시장ㆍ군수 또는 구청장은 제1항 본문에 따라 시설물의 소유자가 무상으로 사용할 수 있는 노외주차장을 지정할 때에는 해당 시설물로부터 가장 가까운 거리에 있는 주차장을 지정하여야 한다. 다만, 그 주차장의 주차난이 심하거나 그 밖에 그 주차장을 이용하게 하기 곤란한 사정이 있는 경우에는 시설물 소유자의 동의를 받아 그 주차장 외의 다른 주차장을 지정할 수 있다.

④ 구청장은 제1항 본문에 따라 무상사용 주차장으로 지정하려는 노외주차장이 특별시장 또는 광역시장이 설치한 노외주차장인 경우에는 미리 해당 특별시장 또는 광역시장과 협의하여야 한다.
