제대혈 관리 및 연구에 관한 법률 제30조(지도ㆍ감독 등)

① 보건복지부장관은 제대혈 및 제대혈제제의 품질관리 및 안전성 향상을 위하여 제대혈은행, 제대혈이식의료기관 및 제대혈정보센터의 소관 업무에 관하여 지도ㆍ감독을 하며, 대통령령으로 정하는 바에 따라 필요한 보고를 명하거나 자료를 제출하게 할 수 있다.

② 보건복지부장관은 필요하다고 인정하면 관계 공무원으로 하여금 제대혈은행, 제대혈이식의료기관 및 제대혈정보센터의 해당 사무소, 사업장이나 그 밖에 필요한 장소에 출입하여 장부, 서류나 그 밖의 물건을 검사하거나 관계인에게 질문하게 할 수 있다.

③ 제2항에 따라 검사를 하려면 검사 5일 전까지 검사일시, 검사목적, 검사내용 등의 검사계획을 검사대상자에게 알려야 한다. 다만, 긴급한 경우 또는 사전에 알리면 증거인멸 등으로 검사목적을 달성할 수 없다고 판단되는 경우에는 그러하지 아니하다.

④ 제2항에 따라 출입ㆍ검사를 하는 공무원은 그 권한을 표시하는 증표를 지니고 이를 관계인에게 내보여야 한다.

⑤ 제1항 및 제2항에 따른 명령ㆍ검사 등을 요구받은 자는 정당한 사유가 없는 한 이에 따라야 한다.
