정보통신공사업법 제37조의4(유지보수등의 위탁 및 유지보수ㆍ관리자 선임 등)

① 관리주체는 공사업자에게 정보통신설비의 유지보수등의 업무를 위탁할 수 있다.

② 관리주체는 과학기술정보통신부령으로 정하는 바에 따라 정보통신설비 유지보수ㆍ관리자를 선임하여야 한다. 다만, 제1항에 따라 정보통신설비 유지보수등의 업무를 위탁한 경우에는 정보통신설비 유지보수ㆍ관리자를 선임한 것으로 본다.

③ 관리주체가 정보통신설비 유지보수ㆍ관리자를 선임 또는 해임한 경우 과학기술정보통신부령으로 정하는 바에 따라 지체 없이 그 사실을 특별자치시장ㆍ특별자치도지사ㆍ시장ㆍ군수ㆍ구청장에게 신고하여야 한다. 신고된 사항 중 과학기술정보통신부령으로 정하는 사항이 변경된 경우에도 또한 같다.

④ 특별자치시장ㆍ특별자치도지사ㆍ시장ㆍ군수ㆍ구청장은 제3항에 따라 정보통신설비 유지보수ㆍ관리자의 선임신고를 한 자가 선임신고증명서의 발급을 요구하는 경우에는 과학기술정보통신부령으로 정하는 바에 따라 선임신고증명서를 발급하여야 한다.

⑤ 제3항에 따라 정보통신설비 유지보수ㆍ관리자의 해임신고를 한 자는 해임한 날부터 30일 이내에 정보통신설비 유지보수ㆍ관리자를 새로 선임하여야 한다.

⑥ 정보통신설비 유지보수ㆍ관리자의 자격기준, 선임절차와 그 밖에 필요한 사항은 대통령령으로 정한다.
