정보통신공사업법 제17조(공사업의 양도 등)

① 공사업자는 다음 각 호의 어느 하나에 해당하면 대통령령으로 정하는 바에 따라 시ㆍ도지사에게 신고를 하여야 한다. 다만, 제3호의 경우에는 공사업자의 상속인이 시ㆍ도지사에게 신고를 하여야 한다. <개정 2018.12.24>

② 제1항에 따른 공사업 양도의 신고가 수리된 경우에는 공사업을 양수한 자는 공사업을 양도한 자의 공사업자로서의 지위를 승계하며, 법인의 합병신고가 수리된 경우에는 합병으로 설립되거나 존속하는 법인이 합병으로 소멸되는 법인의 공사업자로서의 지위를 승계하고, 상속 신고가 수리된 경우에는 그 상속인이 사망한 사람의 공사업자로서의 지위를 승계한다. <개정 2018.12.24>

③ 상속인이 제1항 각 호 외의 부분 단서에 따른 신고를 한 경우에는 피상속인이 사망한 때부터 신고가 수리될 때까지의 기간 동안은 상속인이 공사업자로 등록된 것으로 본다. <신설 2018.12.24>
