Enforcement Decree of the Act on the Use and Promotion of Electronic Procurement, Article 9-2 (Construction and Operation of Self-Operated Electronic Procurement Systems)

① 법 제14조제1항에서 "대통령령으로 정하는 요건"이란 다음 각 호의 어느 하나를 말한다.

② 법 제14조제3항에서 "대통령령으로 정하는 요건을 충족하지 못하게 된 경우"란 제1항 각 호의 어느 하나에도 해당하지 않는 경우로서 법 제12조제3항에 따라 고시된 기준 중 조달청장이 정하는 기준을 충족하지 못하는 경우를 말한다.

③ 재정경제부장관은 법 제14조제5항에 따라 다음 각 호의 권한을 조달청장에게 위임한다. 다만, 신규로 자체전자조달시스템을 구축하게 하거나 기존에 구축된 자체전자조달시스템을 전자조달시스템으로 이용전환을 하도록 요구하는 때에는 미리 재정경제부장관과 협의해야 한다. <개정 2025.12.30>
