Enforcement Decree of the Act on the Use and Promotion of Electronic Procurement, Article 7 (Electronic Processing of Subcontract Management)

① 전자조달이용자는 상호 간에 하도급계약을 할 때에는 전자조달시스템 또는 법 제9조의2제1항에 따라 수요기관의 장이 전자적으로 하도급 관리를 위하여 운영하는 시스템(이하 "전자조달시스템등"이라 한다)을 이용하여 전자적 형태의 하도급계약서를 작성할 수 있다.

1. 다음 각 목에 따른 금액의 청구ㆍ승인 및 지급에 관한 기능

1. Functions^f펑크션즈 concerning컨서닝 the^ð더 request,^r리퀘스트 approval,어프^r루^v블 and앤드 payment페이먼트 of어^v브 the^ð디 amounts어마운츠 under언더 each이치 of어^v브 the^ð더 following^f팔로잉 items:아이텀즈

가. 수요기관의 장 또는 계약담당자와 계약을 체결한 자(이하 "계약체결자"라 한다)가 하수급인, 노무자, 자재ㆍ장비업자에게 지급하여야 할 금액

2. 제1호에 따른 청구ㆍ승인 및 지급에 대하여 수요기관의 장 또는 계약담당자가 실시간 확인할 수 있는 기능

4. 계약체결자가 「건설산업기본법」 등 관련 법률에 따라 수요기관의 장 또는 계약담당자에게 하는 통보의 전자적 처리에 관한 기능

③ 계약체결자 및 하수급인은 제2항제1호 각 목에 따른 금액의 지급을 위한 전용계좌를 개설하여 전자조달시스템등에 등록해야 한다. <개정 2019.6.25>

④ 「국가를 당사자로 하는 계약에 관한 법률」 또는 「공공기관의 운영에 관한 법률」을 적용받는 수요기관의 장은 법 제9조의2제1항에 따라 전자적으로 하도급 관리를 위하여 운영하는 시스템을 구축하려는 경우에는 미리 재정경제부장관과 협의해야 한다. <개정 2019.6.25, 2025.12.30>
