전남광주통합특별시 설치를 위한 특별법 제17조(통합특별시 사무의 단계적 이양 및 자치권 강화 특례)

① 통합특별시는 자치분권의 실현과 시ㆍ군ㆍ구의 자율성 확대를 위하여 통합특별시의 사무 중 다음 각 호에 해당하는 사무를 제외하고는 「지방자치법」 제14조에 따른 사무배분기준에 따라 관할구역의 시ㆍ군ㆍ구에 이양하여야 한다.

② 제1항에 따라 시ㆍ군ㆍ구로 이양할 사무를 발굴하고 심의하기 위하여 통합특별시장 소속으로 독립적인 전남광주자치분권심의위원회(이하 이 조에서 "위원회"라 한다)를 둔다. 이 경우 위원회는 위원장을 포함하여 20명 이내의 위원으로 구성하되, 민간 전문가와 시ㆍ군ㆍ구의 입장을 대변하는 인사가 과반수 이상 포함되어야 한다.

③ 통합특별시장은 위원회의 심의결과를 반영하여 매년 사무이양 시행계획을 수립하고 이를 통합특별시의회에 보고한 후 공고하여야 한다. 이 경우 사무이양 시행계획에는 이양 대상사무, 예산지원 규모, 인력 재배치 및 지원방안 등이 포함되어야 한다.

④ 제1항부터 제3항까지에 따라 시ㆍ군ㆍ구로 이양하기로 결정된 사무는 「지방자치법」 및 그 밖의 다른 법률에서 해당 사무를 통합특별시의 사무로 규정하고 있음에도 불구하고 이 법에서 통합특별시 소속 시ㆍ군ㆍ구의 사무로 규정할 수 있다.

⑤ 통합특별시장은 사무이양으로 인하여 시ㆍ군ㆍ구에 과도한 재정적ㆍ인적 부담이 발생하지 아니하도록 제3항의 사무이양 시행계획에 따라 행정적ㆍ재정적 지원을 병행하여야 한다. 이양된 사무의 처리가 위법하거나 주민의 이익을 현저히 해친다고 판단되는 경우 통합특별시장은 시정명령 등 최소한의 사후관리 조치를 취할 수 있다.

⑥ 제1항부터 제5항까지에서 규정한 사항 외에 위원회의 구성 및 운영, 사무이양 시행계획 수립절차 및 후속조치 등 필요한 사항은 통합특별시조례로 정한다.
