Enforcement Decree of the Electrical Construction Business Act, Article 6 (Registration of Construction Business, etc.)

① 법 제4조제2항에 따라 공사업의 등록을 하려는 자가 갖추어야 할 기술능력, 자본금 및 사무실 등에 관한 기준은 다음 각 호와 같다. <개정 2013.3.23, 2015.9.1, 2025.10.1>

2. 「전기공사공제조합법」에 따른 전기공사공제조합 또는 기후에너지환경부장관이 지정하는 금융기관(이하 이 조에서 "공제조합등"이라 한다)이 다음 각 목의 요건을 모두 갖추어 발급하는 보증가능금액확인서(이하 이 조에서 "보증가능금액확인서"라 한다)를 제출할 것

가. 공제조합등이 보증가능금액확인서의 발급을 신청하는 자의 재무상태ㆍ신용상태 등을 평가하여 제1호에 따른 자본금 기준금액의 100분의 25 이상에 해당하는 금액의 담보를 제공받거나 현금의 예치 또는 출자를 받을 것

나. 공제조합등이 보증가능금액확인서의 발급을 받는 자에게 제1호에 따른 자본금 기준금액 이상의 금액에 대하여 「전기공사공제조합법시행령」 제10조의2에 따른 보증을 할 수 있다는 내용을 보증가능금액확인서에 적을 것

② 보증가능금액확인서를 발급하는 공제조합등은 기후에너지환경부장관이 정하여 고시하는 보증가능금액확인서의 발급 및 해지에 관한 기준에 따라 세부기준을 정하여 공시하여야 한다. <신설 2015.9.1, 2025.10.1>

③ 특별시장ㆍ광역시장ㆍ도지사 또는 특별자치도지사(이하 "시ㆍ도지사"라 한다)는 법 제4조제1항에 따른 공사업의 등록 신청이 다음 각 호의 어느 하나에 해당하는 경우를 제외하고는 등록을 해 주어야 한다. <신설 2011.12.30, 2015.9.1>
