전기공사공제조합법 제12조(조합의 지분 취득 등)

① 조합은 다음 각 호의 어느 하나에 해당할 때에는 조합원이나 조합원이었던 자의 지분을 취득할 수 있다. 다만, 제1호, 제3호 및 제4호에 해당할 때에는 그 지분을 취득하여야 한다.

② 조합은 제1항에 따라 지분을 취득한 경우 같은 항 제1호에 해당할 때에는 지체 없이 출자금의 감소절차를 밟아야 하고, 같은 항 제2호부터 제4호까지의 규정에 해당할 때에는 빠른 시일 내에 지분을 처분하여야 한다.

③ 조합원의 지분은 조합에 대한 채무의 담보로 제공되는 경우 외에는 질권의 목적으로 할 수 없다.

④ 조합원이나 조합원이었던 자가 조합에 대하여 가지는 정산금 청구권은 청구할 수 있는 날부터 5년간 행사하지 아니하면 시효로 소멸한다.
