재해위험 개선사업 및 이주대책에 관한 특별법 시행령 제26조(토지상환채권의 이전 등)

① 토지상환채권을 이전하는 경우 이를 이전받은 자는 그 성명과 주소를 토지상환채권 원부에 기재하여 줄 것을 발행자에게 요구하여야 하며, 취득자의 성명과 주소가 토지상환채권 원부에 기재되지 아니하면 취득자는 발행자 또는 제3자에게 대항하지 못한다.

(1) When웬 a어 land랜드 redemption^r리뎀프션 bond반드 is이즈 transferred,트^r랜스^f퍼드 the^ð더 transferee트^r랜스^f퍼^r리 shall섈 request^r리퀘스트 the^ð디 issuer이슈어 to투 enter엔터 the^ð더 transferee's트^r랜스^f퍼^r리즈 name네임 and앤드 address애드^r레스 in인 the^ð더 land랜드 redemption^r리뎀프션 bond반드 register,^r레지스터 and앤드 unless언레스 the^ð더 transferee's트^r랜스^f퍼^r리즈 name네임 and앤드 address애드^r레스 are아 entered엔터드 in인 the^ð더 land랜드 redemption^r리뎀프션 bond반드 register,^r레지스터 the^ð더 transferee트^r랜스^f퍼^r리 cannot캐낫 assert어섯 the^ð더 transfer트^r랜스^f퍼 against어겐스트 the^ð디 issuer이슈어 or오 a어 third^θ써드 party.파티

② 토지상환채권을 질권의 목적으로 하는 경우 질권자는 그 성명과 주소를 토지상환채권 원부에 기재하여 줄 것을 요구하여야 하며, 질권자의 성명과 주소가 토지상환채권 원부에 기재되지 아니하면 질권자는 발행자 또는 제3자에게 대항하지 못한다.

(2) When웬 a어 land랜드 redemption^r리뎀프션 bond반드 is이즈 made메이드 the^ð더 subject서브젝트 of어^v브 a어 pledge,플레지 the^ð더 pledgee플레지 shall섈 request^r리퀘스트 that^ð댓 the^ð더 pledgee's플레지즈 name네임 and앤드 address애드^r레스 be비 entered엔터드 in인 the^ð더 land랜드 redemption^r리뎀프션 bond반드 register,^r레지스터 and앤드 unless언레스 the^ð더 pledgee's플레지즈 name네임 and앤드 address애드^r레스 are아 entered엔터드 in인 the^ð더 land랜드 redemption^r리뎀프션 bond반드 register,^r레지스터 the^ð더 pledgee플레지 cannot캐낫 assert어섯 the^ð더 pledge플레지 against어겐스트 the^ð디 issuer이슈어 or오 a어 third^θ써드 party.파티

③ 토지상환채권의 발행자는 제2항에 따라 질권이 설정된 때에는 토지상환채권에 그 사실을 표시하여야 한다.

(3) When웬 a어 pledge플레지 is이즈 created크^r리에이티드 under언더 paragraph패^r러그^r래^f프 (2), the^ð디 issuer이슈어 of어^v브 the^ð더 land랜드 redemption^r리뎀프션 bond반드 shall섈 indicate인더케잇 that^ð댓 fact^f팩트 on안 the^ð더 land랜드 redemption^r리뎀프션 bond.반드

④ 토지상환채권의 발행자는 제1항 또는 제2항에 따른 요구를 받으면 그 요구에 응하여야 한다.

(4) The^ð디 issuer이슈어 of어^v브 a어 land랜드 redemption^r리뎀프션 bond반드 shall섈 comply컴플라이 with위^ð드 a어 request^r리퀘스트 under언더 paragraph패^r러그^r래^f프 (1) or오 (2).
